Welcome to PadeLGBT.
These Terms of Service apply to the website and online store operated by Stichting PadeLGBT ("PadeLGBT", "we", "us" or "our"). Our online store is powered by Shopify, which enables us to offer our products and services to you.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy and any other policies referenced on our website, describe the terms that apply when you visit our website, use our services or purchase products from us.
By accessing our website or purchasing from us, you agree to these Terms of Service.
Nothing in these Terms limits any mandatory rights you have under applicable Dutch or European Union consumer law.

PadeLGBT is a community organisation and Stichting registered in the Netherlands.
2. OUR PRODUCTS
We aim to display and describe our products as accurately as possible. However, colours, sizing and appearance may vary slightly depending on your screen, device, manufacturing process or individual product.
Many PadeLGBT products are produced or fulfilled for us by third-party production and fulfilment partners. This means that products may be manufactured after an order is placed.
We may change, discontinue or update products, designs, availability or prices at any time.
Product availability is not guaranteed until an order has been accepted.
3. ORDERS
When you place an order through our online store, you are making an offer to purchase the selected products.
After placing your order, you will receive an electronic confirmation. We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including suspected fraud, payment problems, incorrect pricing, product unavailability or technical errors.
If we cancel an order after payment has been received, we will refund the applicable amount.
Please review your order carefully before submitting it. Because some products may enter production shortly after an order is placed, changes or cancellations may not always be possible once fulfilment has started.
Your statutory cancellation and withdrawal rights remain unaffected.
4. PRICES AND PAYMENT
All prices are displayed in euros (€) unless otherwise indicated.
Where required by law, applicable VAT is included in the displayed price or clearly identified during checkout.
Shipping costs, where applicable, will be displayed before you complete your purchase.
Available payment methods are shown during checkout and may include payment cards, digital wallets and local payment methods supported by Shopify Payments.
Payment must be successfully authorised before an order can be processed.
You are responsible for providing accurate and complete billing, payment and contact information.
5. SHIPPING AND DELIVERY
We ship orders using third-party fulfilment partners and delivery carriers.
Available shipping options, estimated delivery times and applicable shipping charges are displayed during checkout where available.
Delivery dates and times are estimates and may be affected by production times, carrier delays, customs procedures, public holidays or circumstances outside our reasonable control.
If an order is significantly delayed, lost or otherwise not delivered, please contact us at padelgbt@gmail.com so that we can investigate.
Nothing in this section limits your statutory rights relating to delivery under Dutch or European Union consumer law.
6. CANCELLATIONS, RETURNS AND REFUNDS
Returns, cancellations, exchanges and refunds are governed by our Return and Refund Policy.
Consumers purchasing online may have a statutory right to withdraw from their purchase within 14 days after receiving their order, subject to the exceptions permitted under applicable law.
Where a statutory right of withdrawal applies, you do not need to provide a reason for exercising that right.
Products must generally be returned in appropriate condition. You may be responsible for any reduction in value resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.
Certain products may be excluded from the statutory right of withdrawal where an applicable legal exception applies.
Products that arrive damaged, defective, misprinted or materially different from what was ordered should be reported to us as soon as reasonably possible at padelgbt@gmail.com.

7. INTELLECTUAL PROPERTY
Unless otherwise indicated, the content of the PadeLGBT website and store, including our name, logos, designs, graphics, photographs, text and other original content, is owned by or licensed to Stichting PadeLGBT and is protected by applicable intellectual property laws.
You may use our website for your personal, non-commercial use.
You may not reproduce, distribute, sell, modify or commercially exploit PadeLGBT content, branding, logos or designs without our prior written permission.
Third-party names, trademarks and logos remain the property of their respective owners.
8. ACCEPTABLE USE
You may use our website and services only for lawful purposes.
You must not use the website or services to:
• violate applicable laws or regulations;
• infringe the intellectual property or other rights of another person;
• submit false, fraudulent or misleading information;
• transmit malicious software or code;
• interfere with the security or operation of the website;
• attempt to gain unauthorised access to our systems;
• scrape or systematically extract information from our website without permission;
• impersonate another person or organisation; or
• use our services in a way that could harm PadeLGBT, Shopify, our partners or other users.
We may restrict or terminate access to our services where we reasonably believe these Terms have been violated.

Our website may use or provide access to services operated by third parties, including payment providers, fulfilment partners, shipping carriers and other technology providers.
Your use of certain third-party services may also be subject to the terms and policies of those providers.
We are not responsible for independent third-party websites that you choose to access through external links on our website.
10. SHOPIFY
Our online store is powered by Shopify.
Shopify provides the technology that enables us to operate the online store, but products purchased through the PadeLGBT store are sold by Stichting PadeLGBT.
Your purchase agreement is therefore with Stichting PadeLGBT and not with Shopify.
Shopify may process certain information as necessary to provide its services. Further information about the processing of personal data is available in our Privacy Policy.
11. PRIVACY AND PERSONAL DATA
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).
When you place an order, we may process information including your name, email address, billing details, shipping address and order information where necessary to process and fulfil your purchase.
Information may also be processed by service providers involved in operating the store, processing payments, producing products and delivering orders.

12. PRODUCT REVIEWS AND USER CONTENT
If you submit a review, photograph, comment or other content to us or through our website, you confirm that you have the right to provide that content.
You must not submit content that is unlawful, misleading, discriminatory, abusive, defamatory or that infringes another person's rights.
Where you submit content for publication on our website or social channels, you grant Stichting PadeLGBT permission to use that content for purposes reasonably connected with operating and promoting PadeLGBT, unless otherwise agreed.
You retain ownership of your original content.
13. ERRORS AND INACCURACIES
We make reasonable efforts to ensure that information on our website is accurate.
Occasionally, information may contain typographical errors, incorrect prices, inaccurate product descriptions or other mistakes.
We reserve the right to correct such errors and, where necessary, contact you regarding an affected order.
Nothing in this section limits your statutory consumer rights.
14. WARRANTIES AND CONSUMER RIGHTS
Nothing in these Terms excludes or limits warranties, remedies or other rights that cannot legally be excluded or limited under Dutch or European Union consumer law.
Products supplied by us must comply with the agreement and with applicable statutory conformity requirements.

15. LIABILITY
We are responsible for our obligations to you in accordance with applicable law.
To the extent permitted by law, Stichting PadeLGBT is not liable for indirect or consequential losses that were not reasonably foreseeable when you entered into the agreement with us.
We are not responsible for failures or delays caused by circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability for intentional misconduct or where mandatory consumer law provides otherwise.
16. FORCE MAJEURE
We are not responsible for delays or failure to perform our obligations where this results from circumstances outside our reasonable control.
Such circumstances may include severe weather, natural disasters, transport disruptions, strikes, governmental actions, failures of third-party infrastructure or other events that could not reasonably have been prevented.
Your mandatory consumer rights remain unaffected.
17. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our services, business operations or applicable laws.
The Terms applicable to your purchase are generally those in effect when your order is placed.
The current version of these Terms will be available on our website.
18. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
19. GOVERNING LAW
These Terms and purchases made through the PadeLGBT online store are governed by Dutch law.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections available to you under the laws that would otherwise apply.
Any dispute will be handled by the competent court in accordance with applicable law.
